Employer property rights versus union right to access

Article Abstract:

The US Supreme Court in Lechmere, Inc. v. NLRB tried to balance an employer's private property rights with employees' rights to organize under the National Labor Relations Act. Traditionally, the Court has allowed the NLRB to resolve conflicts between these rights. The employer in Lechmere appealed a holding of an unfair labor practice when it barred union organizers from its parking lot. The court held that the union could have access in this case since the location of the workplace and employee living quarters placed employees beyond reasonable union access if the union could not enter employer property.

Decertification strategies and tactics: management and union perspectives

Article Abstract:

Management and union representatives were surveyed concerning their roles in a decertification campaign caused by either satisfaction with working conditions or economics issues. These two issues did not qualify as predictors of decertification campaigns. Both classes of respondents agreed that things learned during a certification campaign could be applied to decertification campaigns as well. Strategies stressing direct contact with employees were considered the most useful during decertification campaigns.

The determinants of incumbent union victory in raid elections

Article Abstract:

Union raid election practices between 1975 and 1989 were examined with a view toward learning the predictors of election results for incumbent unions. The study shows that incumbent union successes occurred in states with higher proportions of unionization, increased unemployment, and bigger collective bargaining units. No statistically important connection was discovered between the chance of incumbent victory and the kind of election, legal environment, or proportion of the industry unionized.
