Employment law; benefits for 'temps.'

Article Abstract:

The growing trend to use temporary employees or independent contractors to do the work of traditional employees and their litigation for fringe benefits is discussed. Vizcaino v. U.S. District Court, brought by independent contractors working for Microsoft, and Herman v. Time Warner, Inc., are discussed.

Article Abstract:

The NLRB's decision in Epilepsy Foundation of Northeast Ohio extending the National Labor Relations Act to employers with non-union employees is discussed, when such employees consider themselves to be under disciplinary investigation. This also extends NLRB v. Weingarten, Inc. to non-union employees.

Employment law; monitoring employee e-mail

Article Abstract:

The prevalence of monitoring of employees' e-mail and the bearing of the Electronic Communications Privacy Act of 1986 on this issue is discussed. Such monitoring totals 67%, justified by employers with a need to prevent the unauthorized transmission of trade secrets.
