The expansion of patent venue underthe Judicial Improvements and Access to Justice Act

Article Abstract:

The Judicial Improvements and Access to Justice Act of 1988 restricted proper venue in patent suits against corporations to districts where the corporation resides and where both infringement occurred and the corporation has a place of business. The statutory revision was intended to narrow and better define where plaintiffs may bring actions in multidistrict states. General corporate venue focuses on district of incorporation, district where licensed and district where doing business.

The Orphan Patent Act

Article Abstract:

A proposed Orphan Patent Act would facilitate the invention of products to assist the handicapped. This act would thereby facilitate the implementation of the 1990 Americans with Disabilities Act in the workplace. No method presently exists to speed up patent processing at the Patent and Trademark Office to comply with the 1990 handicapped law. The Orphan Patent Act would allow a special petition under section 708.02 in the Office's Manual of Patent Examining Procedure.
