Extraterritoriality in U.S. and EU antitrust enforcement

Article Abstract:

The US and the European Union (EU) developed policies for the extraterritorial enforcement of their antitrust and competition laws. The US bases such jurisdiction primarily on the effects test, though some courts and commentators prefer the balancing test. The EU used the implementation test. In 1991 and 1998, the US and EU reached agreements for greater cooperation in this area. However, the two sides' differing antitrust standards are likely to remain a sticking point.
