Family law; the care behind custody

Article Abstract:

Empirical evidence suggests that divorce itself does not harm children but an ongoing conflict after the final decree does. One way to prevent this and to avoid alienated feelings is to use cooperative language in child custody agreements. Attorneys should speak about 'shared parental responsibilities' instead of 'rights to custody.' Framing initial proposals in cooperative terms increases the chance of a response in kind. This approach increases the chance of cooperation and of better parental contact post-divorce.

Family law; preparing clients for battle

Article Abstract:

Detailed preparation of clients before a custody trial is vital, and written handouts for the client are a good start, but this must be followed by a detailed discussion. Experience has shown that attempts to enmesh children in the legal process by involving them in discussions usually end up being interpreted as the client's attempts to unduly influence the child. The preparation should pay attention to deposition strategy, to direct examination and to cross-examination.

School expenses

Article Abstract:

Including college fees in child support is discussed. Agreements for child support payments should consider fees for post-secondary education, although state courts have different views on the matter. Living expenses for college students and mandating that a parent help with the repayment of loans might also be considered.
