Finding the way back home: funding for home school children under the Individuals with Disabilities Education Act

Article Abstract:

In Hooks v. Clark County School District, the Court of Appeals for the 9th Circuit decided that state law should decide if home schooled children are eligible for the same benefits as children in private schools. This decision violates the fundamental purpose of the Individuals with Disabilities Act and should be reversed to ensure home schooled children equal benefits.

Putting the "community" back in common interest communities: a proposal for participation-enhancing procedural review

Article Abstract:

Judicial standards of review that have been applied to cases challenging common-interest communities are analyzed. The author examines the deferential treatment traditionally received by community governing boards and suggests that judges be more critical of hierarchical board decisions and encourage boards to elicit greater participation by residents.

The preexistence principle and the structure of the class action

Article Abstract:

The "preexistence principle" states that class-action lawsuits must not extinguish the rights of class members. Class actions in which participation is mandatory are only justified when preexisting rights are in conflict. Class actions are vehicles for the redress of wrongs; they should not be instruments of public policy.
