Forum selection; removal and remand

Article Abstract:

The laws governing removal and procedure for remand are in 28 USC 1446-1447 and amendments to 1446(b), adopted in 1988, have been strictly construed and reflect Congress' command to limit removal of cases from state courts. Congress has also placed a one-year time limit on removing diversity claims as a part of its intention to restrict diversity jurisdiction. Relevant case law is reviewed.

Forum selection; removal traps

Article Abstract:

The removal statute under consideration by Congress is discussed. Removal must take place within 30 days of the time of service if grounds for removal are apparent at that time. A notice of removable should be filed within 30 days of the receipt of an amended pleading or motion.
