Article Abstract:

The finding of the High Court of Australia that the cross-vesting of jurisdiction scheme was unconstitutional with respect to state matters in federal courts, is discussed. The article stresses that grave and unfortunate consequences of the High Court's decision for administration of law, particularly commercial law, in Australia.

Federal award simplification: past, present and future

Article Abstract:

Australia's Workplace Relations Act 1996, which simplified the federal system's award process, is discussed. Topics include the use of awards as a benchmarks against which entitlements are measured, the limits of the Australian Industrial Relations Commission's arbitral role, and recent proposals for additional reforms.
