Getting a fix on fees: computers chip away at hourly billing in real estate matters

Article Abstract:

Law firms are under increasing pressure to quote fixed fees for real-estate transaction work, a challenging task for which computer technology and careful planning can be of assistance. The firm should review its files and break the work down into discrete categories, such as due diligence and closing, each with its own subcategories. Appropriate computer software can speed both this process and subsequent data analysis, enabling any lawyer in the real estate group to calculate a fee and supporting documentation within minutes.

Real reform

Article Abstract:

Reform of the legal system to make justice quicker and more affordable demands that lawyers rethink zealous advocacy and relinquish hourly billing. Substantive and procedural reforms have proven inadequate for foreseeable reasons, and the adversarial process imposes restrictions on what can work and how well. Changes in billing practices and in the lawyer culture demanding ridiculous hours and expenses are already underway, driven by clients who want attorneys to represent their true best interests.

The article describes the opinion of many practicing psychologists and even attorneys that lawyers emphasize intellect more than feelings, and that this leads to frequent trouble systaining relationships. The current law firm culture can also be a cause, because it can demand of employees that they subordinate the needs of the family to work. Suggestions for building skills in personal life are given.
