Article Abstract:

The author discusses the UK House of Lord's decisions in Islam v. Secretary of State for the Home Department and R. v. Immigration Appeal Tribunal (ex parte Shah), in which the court was divided on whether women constitute a social group eligible for protection under the international refugee convention.

The author discusses the Inter-American Court of Human Rights' decision in Castillo Pertruzzi, in which Chilean nationals convicted by a Peruvian military court were deemed to have not received a fair trial and that the military court was not competent to try civilians.
