Insuring good faith: disputes over settling cases can give rise to claims against insurers

Article Abstract:

Insurance companies owe a duty of good faith and fair dealing in settlement transactions for their policyholders. Bad faith disputes usually happen when the policyholder wants a settlement but the insurance company refuses, and such a situation is the most common when the potential liability of the policyholder exceeds the policy limits. A policyholder whose insurance company treats its own interests as more important must act quickly. Possible signs of bad faith include the strength of the claimant's case and the insurance company's lack of diligent case investigation.

Fighting over a good education: quality of schools can be a key factor in the outcome of custody cases

Article Abstract:

The quality of schools in a particular locale is an important factor in custody decisions. Evidence on schools should include school size, rural or urban location, public or private sponsorship, and statistical information such as the average size of each class. Parents and lawyers can obtain this type of information from the school district and from boards of education, then hire a local expert to review and, if necessary, present it. If money is no object, a service such as School Match can be retained.

New gains for battered-child defense: executive clemency granted in two cases where parent killers claimed abuse

Article Abstract:

Two convicted killers of their parents were recently granted executive clemency on the grounds of their abuse as children. In FL, the clemency board commuted the mandatory portion of Elec Trubilla's sentence before the youth, 14 at the time of the Aug 1992 killing, had even exhausted his appeals. In MD, Linda Sue Glazier was freed after 20 years in custody. In neither case was abuse alleged in the trial. Critics in both cases doubt that abuse actually occurred.
