Public procurement: Business opportunity or Holy Grail?

Article Abstract:

The public procurement opportunities outlined by the Commission are fundamentally unattainable, hampered by practical, legal and political barriers. Public procurement law is flagrantly violated and purchasers complain that the EU rules are too inflexible. The Commission is addressing some of the problems, concentrating on the issue of implementation, which should be welcomed by industry.

The Commission's follow up to its green paper on vertical restraints proposes the introduction of a single block exemption, providing a blacklist of vertical restraints. With regard to merger control the Commission's merger task force has approved several mergers, but has fined Samsung for its failure to notify that it it had taken over AST of the US, a computer company.
