International Centre for Settlement of investment Disputes: Decision on Liability

Article Abstract:

The proceedings between LG&E Energy Corporation, LG&E Capital Corporation and LG&E International Inc. as claimants and Argentine Republic as respondent regarding the tariffs on Investment by the companies in Argentine Gas distribution sector, is presented. The tribunal concluded that Argentina violated the fair and equitable treatment provision in the Bilateral Treaty, but dismissed the claim for expropriation of investment.
