International arbitration under U.S. law and AAA rules

Article Abstract:

The arbitration laws of individual states and nations plays a significant role in the application and execution of arbitral agreements between international commercial parties. Choice of location for the arbitration will affect its course by determining the law governing such proceedings. US and other laws contain restrictions and provisions from which the parties to arbitration may not depart, but tend to encourage the use of arbitration and to discourage judicial interference.

Enforcing arbitration awards

Article Abstract:

In cases of arbitration where the losing side seeks to deny or delay surrender of an award the courts can readily render a judgment through streamlined rules. Most enforcement procedures fall under the Federal Arbitration Act, though some fall under the similar Uniform Arbitration Act. Procedures for making the judgment binding, and for handling motions to vacate, modify, or correct, are described.

Commercial arbitration: winning over the skeptics

Article Abstract:

Three steps can be taken to enhance the likelihood that arbitration for commercial disputes will provide a just outcome: disputants should specify the qualifications they want in an arbitrator; three arbitrators should be used to ensure that all facts are presented to the neutral arbitrator; and arbitrators should make their decisions based on existing law.
