International intellectual property dispute resolution: is mediation a sleeping giant?

Article Abstract:

International intellectual property disputes within the high-technology industry are well-suited to mediation because mediation provides prompt resolution and maintains ongoing professional relationships. Arbitration has been used to solve disputes but in the late 1990s, mediation may become more popular. Parties can choose among four international auspices, including the International Chamber of Commerce and the World Intellectual Property Arbitration Centre, to conduct mediation.

Managing international arbitration; a shared responsibility of the parties, the tribunal, and the arbitral institution

Article Abstract:

Improved case management is presented as a key advantage of achieving harmonization of international arbitration. The aim of the American Arbitration Ass'n Rules Revision Task Force was to expedite the process. Limited document production in discovery and no depositions will help expedite the process. Other means of reducing delays and costs are presented.
