Is creeping legalism infecting arbitration?

Article Abstract:

Many parties in commercial disputes are disenchanted with arbitration because they perceive it to have become too much like litigation. The involvement of lawyers in arbitration has helped lead to this feeling. A survey of professional aribrators is presented in which they offer suggestions as to how lawyers can handle arbitration in a way that preserves its unique advantages over litigation.

Issues regarding resistance to mediation in the entertainment industry. Cultural reasons as well as management and counsel's unfamiliarity with mediation are the main reasons the process is not used.
