Judicial review of UN sanctions by the Court of First Instance

Article Abstract:

The UN Security Council's power to impose economic sanctions against a state enables it to meet its responsibility of maintaining peace and security and since 1990 it has used this power increasingly in response to serious political crisis. Its more recent act of using sanctions as a weapon in the 'war against terror' by targeting specific individuals and private organizations is scrutinized in the light of the judgment issued by the Court of First Instance in the 'Yusuf' and 'Kadi' cases.

Why and to what extent a common interpretative position for mixed agreements?

Article Abstract:

Mixed agreements to which the European Community as well as its Member States are parties have evolved as the main feature of the external relations of the Community and are also due to become the main feature of the external relations of the European Union. An exploration is undertaken of whether, why and to what extent the European Court of Justice (ECJ) has interpretative jurisdiction over mixed agreements in the light of case law.
