Keynote address: administrative procedure and the decline of responsibility

Article Abstract:

Administrative procedure needs to be overhauled to promote responsibility and accountability and to replace current attempts to legislate common sense. The excess number of warnings and procedures is inefficient, hampers economic growth, and disables personal and political decision-making. Republican calls for regulatory reform are correct to the extent that cost-benefit analysis will lead to more active assessment of administrative acts and rules, but expanded judicial review of administrative process will only lead to more obstructionist litigation.

The author discusses SEC regulatory supervision which differs from its rulemaking, adjudicatory, and enforcement functions. The supervisory function is an important means of preventive regulation which is accomplished through cooperative and confidential methods.
