Affirmative action: a focus on the issues

Article Abstract:

A public debate over affirmative action is necessary and seems inevitable but could cause considerable social harm if it does not focus on substantive issues. These issues include how affirmative action affects the individual, organizations, and society in general; the fairness and legality of various aspects of affirmative action; and affirmative action's purposes and goals, namely redressing past injustice, creating economic equality, and ending present discrimination. Each is discussed in detail.

A hardy transplant: the duty to accomodate and disability rights in Canadian labour law

Article Abstract:

Canadian labor law transplanted the American concept of accomodation for the disabled and developed three trends in arbitrations regarding labor law. Arbitrators are not held to express contract provisions, the private law character of labor law changed into a more public debate and the industrial relations systems increased in complexity and scope. Accomodation has allowed for the recognition and better treatment of human rights that are integral to Canadian life.
