Love letters; premarital agreements help smooth divorces - or do they?

Article Abstract:

Antenuptial contracts are often the subject of bitter disputes upon divorce, but attorneys can follow guidelines which may help minimize these disagreements. A clear unimpeachable record that the contract was entered into voluntarily is needed. Each contract must be tailored specifically for the client and include as much detail as possible. The amount of negotiation necessary before drafting the contract will vary from case to case. These contracts are covered in the Uniform Premarital Agreement Act.

Catfight; enforcing consensual property agreements gets tougher

Article Abstract:

California courts are moving away from enforcing promissory servitudes in consensual property agreements. In Nahrstedt v Lakeside Village Condominium Assn, an appellate court agreed with a cat owner that the condominium declarations' anti-pet clause was unenforceable and unreasonable, even though this was a consensual agreement. Attorneys advising condominium associations drafting these agreements may want to provide for binding arbitration of disputes or include 'kick out' or 'buy out' provisions.
