Mending judicial fences: commission suggests ways to dodge politics, bolster public support

Article Abstract:

The ABA Commission on Separation of Powers and Judicial Independence says vicious attacks on the judiciary are unwarranted and opposes efforts to compromise judicial independence or restrict certain federal judges. Threats of judicial impeachment by politicians who disagree with court decisions are similarly improper. Congress should create a permanent federal court commission for evaluating the judiciary, but should not place unconstitutional limits on federal judges. Bar associations should create vehicles for responding to unwarranted criticism of judges.

Was Rand right: conference attendees differ on whether civil justice study was too harsh

Article Abstract:

Federal judges at a Mar 1997 conference discussed the negative effects of the 1990 Civil Justice Reform Act, which had been the subject of a Rand Institute study. Rand found that many of the law's case management guidelines did not significantly streamline federal courts' case backlog or save on costs. Many attendees had characterized the law as micromanagement and felt vindicated by the report's conclusions. Others, however, said judges' intransigence was part of the problem.

Article Abstract:

Public disenchantment with the judiciary has taken on such a confrontational tone that the legal community fears its is compromising judicial independence and the ABA has announced the establishment of a Commission on Separation of Powers and Judicial Independence to study the matter. State court judges get much of the criticism since criminal rulings draw much of the political criticism. The ABA has opposed term limits and pushed for merit selection for judges.
