Modernizing English property law: The influence of internal market principles

Article Abstract:

Electronic conveyancing (e-conveyancing) that would facilitate investigation of title online was introduced in the Land Registration Act 2002 (LRA 2002) for England and Wales. This modernization fulfils one of the European Union's (EU) Lisbon objectives as well as the electronic commerce initiatives that are both geared towards improving the delivery of administrative services to the consumer.

The development of collective legal actions in Europe, especially in German civil procedure

Article Abstract:

The feasibility of the judicial system in Europe and Germany in relation to class action and the comprehensive draft bill put up by the Federal Ministry of Consumer Protection, Nutrition and Agriculture (GVMuG) are discussed. It is concluded that the goal of the GVMuG is to evoke a discussion on the overall concept of collective litigation in order to avoid ad-hoc solutions by the legislator.

Shareholder rights in France and the U.K. in a European perspective

Article Abstract:

The shareholders rights in France and the United Kingdom in a European perspective which are different yet tend to converge in many ways are discussed. Findings reveal that the proposed Directive has introduced a minimum standard to strengthen cross-border shareholders' rights in allowing shareholders to play their full role in the decision-making process of the company.
