On the 'Net, unusual marks gain in importance

Article Abstract:

Trademarks on the Internet go under the rubric of nontraditional as these have these cannot be static and have to do things such as move, sing, and dance to gain the attention of Web surfers. Protecting and registering such marks requires applicants to obtain trademark rights in sound, color and moving images. Applicants must examine the mark's distinctiveness and strength to know if it can be registered. The trade-dress test of the PTO ix explained.

Making sites accessible to the whole wide world; the latest area of ADA concern appears to be the Web, and creating user-friendly sites for the disabled isn't that hard

Article Abstract:

Justice Department opinion dated 9/9/96 requires companies with 15 or more employees using the Internet for communication about their products to offer these communications through means accessible to the handicapped, and deaf- and sight-impaired users usually user the Internet with text-to-speech readers. Text-based software cannot use Web sites not coded specifically lfor these readers, and suggestions for building accessible Web sites are given.
