Move over, Ms. Bingaman; new trustbuster is in D.C.; new FTC chairman Robert Pitofsky's theoretical views may clash with Anne Bingaman's pragmatism at Justice

Article Abstract:

Robert Pitofsky was recently appointed head of the Federal Trade Commission (FTC) where he plans to investigate how antitrust laws fit in a changing global and technological marketplace. His writings suggest a more activist stance and interest in the oft-criticized Robinson-Patman Act, but under his tenure the FTC is unlikely to return to the radical approach of the late 1970s. Some observers think Justice Dept antitrust division head Anne K. Bingaman's role may change in the new political climate.

Group standard-setting grows more significant; de jure standard-setting raises patent enforceability issues as well as antitrust implications

Article Abstract:

The standards set by industry groups or consortia are called de jure standards, and the group nature of the activity can change a patent owners' rights, subjecting them to bylaws or other contractual obligations that can limit patent enforcing or licensing. The group nature of the activity also subjects patent owners to antitrust and other laws regulating economic activity among competitors.

Bar group tackles bankruptcy and antitrust issues

Article Abstract:

Bankruptcy appellate panels (BAPs) and telemarketing fraud legislation were the chief topics for bankruptcy and antitrust lawyers at the ABA's midyear meeting in Dallas, Texas. The House of Delegates voted to support legislation urging the creation of BAPs. The antitrust law section was unable to pass its opposition to provisions in pending telemarketing fraud legislation.
