New York lawyers gather for annual meeting

Article Abstract:

The fiscal crisis affecting New York State's civil court system was the dominant topic at the New York Bar Association's annual meeting in Manhattan. In Sep 1991 nearly one-third of New York's civil courts were closed due to lack of money, prompting a lawsuit by the state's chief judge, Sol Wachtler, against Governor Mario Cuomo. The use of private justice to alleviate the financial crisis was welcomed by some delegates and denounced by others. Sexual harassment and the use of cameras in court were also discussed.

Executors are reinstated in Dorik Duke estate fight; New York's high court raps trial judge for removing them without a hearing

Article Abstract:

NY's highest court on Jan 11 rebuked Manhattan Surrogate Eve Preminger and reinstated the US Trust Co and Bernard Lafferty as co-executors of Doris Duke's $1.2 billion estate. The Court of Appeals opinion, written by Judge Vito J Titone, said Preminger abused her discretion by removing without a hearing the chosen executors, based on hearsay gathered by an investigator. The battle over Duke's estate has drawn headlines nationwide, in part because Lafferty, Duke's former butler, is accused of abusing his position.

Medicaid counseling law struck in New York; federal judge says law could inhibit lawyers from giving advice to clients

Article Abstract:

New York State Bar Ass'n v. Reno has struck down a federal law exposing lawyers who advised clients on how to shield assets so that they could qualify for Medicaid to prosecution. The law is in Section 1128B(a)(6) of the Social Security Act, and the court ruled that it would preclude lawyers from advising clients to engage in an estate-planning strategy that itself is legal.
