Potential for fabricating recorded evidence grows: technological advances in audio and video recordings may affect court admissibility standards
Article Abstract:
Digital editing technology creates the possibility to not only manipulate but even fabricate both audio and video recordings. Courts thus face the danger of allowing into evidence fabricated electronic evidence. Tighter standards and burdens of proof may keep out some perfectly good evidence but the issue should still be carefully rethought.

Key issues in products liability litigation include questions of what was the state of the art at the time the injury occurred. Plaintiffs often attempt to argue that current state of the art design was not employed. However the relevant question is whether the state of the art design had been employed at the time the accident occurred.
