Outstanding Service Award

Article Abstract:

Merrell C. Cashion, Jr was awarded the Patent and Trademark Office Society's Outstanding Service Award on Feb 23, 1993, for his work at the Office and his active participation in the Society. He is a Supervisory Primary Examiner for Examining Group 1800 and has been very active in the Society's Education and Science Fair Committees. Cashion became Vice-President of the Society in 1988 and served for two years. Currently, he is a member of the Election Committee and served as Committee chair in 1990 while also serving on the Board of Governors for the Society's journal between 1990-1992.

An award for P.J. "Pat" Federico

Article Abstract:

Pasquale J. Federico was a well respected member of the Patent Office who died on Jan 2, 1982. The Pasquale J. Federico Memorial Award was created to honor his achievements in the US patent and trademark systems and to reward individuals, corporations or groups of individuals for outstanding service. Federal Circuit Court of Appeals Judge Giles S. Rich has been selected by the Patent and Trademark Office Society Board of Directors to receive the first Federico Memorial Award.

Public use and on sale issues arising from clinical testing of medical devices

Article Abstract:

Manufacturers may test medical devices in clinical conditions without incurring a ban on public use or sale under section 102(b) of the Patent Code for patent applications. The testing must carefully meet Food and Drug Administration (FDA) regulations for required clinical testing on efficacy and human safety, and is for the purpose of FDA approval of public sales. A patent may be applied for contiguous with the testing.
