Article Abstract:

The Wescol Group has grown from having shareholder funds of 323,000 pounds sterling, in Jul 1992, to having funds of over 13 million pounds sterling by 1997. Wescol lost 2.5 million pounds sterling, in 1992, and was saddled with a number of bad debts. Wescol went under a period of restructuring its business and diversified its construction work into building sports stadiums. It agreed a debt for equity swap with Lloyds Bank along with a rights issue. Wescol is one of the major structural steelwork companies, in the UK, following its purchase of Glosford Holdings, in Jun 1997.

Overcompensation and the "user principle."

Article Abstract:

The Privy Council's application of the user principle in Inverugie Investments Ltd. v. Hackett to determine the value of damages for an extended trespass to land highlights the logical flaws in loss-of-use damages. In this case, the court overcompensated the plaintiff by assuming 100% occupancy of a hotel that had been 35 to 40% occupied in the defendant's possession and operated at a loss. This method of valuation departs from the compensatory goals of restitution by effectively including a punitive component in the award.

TV ratings

Article Abstract:

The proposed television program rating system is being planned to work in conjunction with the V-chip technology. Under the proposal, a show's producer would determine its rating and ratings would only be required for entertainment and children's shows. Critics say the proposed ratings do not go far enough in helping viewers determine program content. The proposal being considered is likely to go through a number of changes before final approval. A list of proposed program ratings is included.
