Patterns in disciplinary violations mark change

Article Abstract:

Most US attorney disciplinary systems are organized on a statewide basis and staffed with full-time lawyer responsible for the preliminary grievance investigations and grievance prosecutions. Most states hold the trials before special grievance tribunals consisting of lay members and lawyers. Across the US, however, the burden of enforcement is carried by the National Organization of Bar Counsel, a professional group of lawyers for lawyers' disciplinary boards and committees.

O'Quinn seeks help for alcohol abuse problem; Houston lawyer's discipline trial postponed while he gets treatment at hospital

Article Abstract:

Lawyers representing Texas trial practitioner John O'Quinn have reached an agreement to postpone his disciplinary suit while he undergoes hospital treatment for alcohol abuse. The disciplinary case alleges that O'Quinn and others conspired to solicit clients after an airplane crash. The Texas Rules of Disciplinary Conduct allow a judge to view disability resulting from alcohol as a mitigating circumstance when imposing sanctions.

The California State Bar had long been known for its reluctance to pursue public complaints about lawyers, but in 1988 finally decided to investigate much-complained-about family lawyer Marvin Mitchelson. Mitchelson's defense technique was to deny and delay, but his tax evasion trial will start in Los Angeles on Dec 1, 1992.
