Petitions and priorities

Article Abstract:

Administrative agencies should be given the discretion to prioritize rule reviews instead of having their priorities dictated to them by litigation. Many of the problems that have triggered the need for regulatory reform have arisen from Congressional unwillingness to trust agencies and grant them a measure of discretion. The layers of bureaucracy and inefficiency are largely a result of attempted reforms by Congress. The right to petition for use of alternative methods of compliance, on the other hand, is one of the most valuable provisions in the proposed legislation.

Risk assessment perspectives from the agency view

Article Abstract:

Regulatory reform at administrative agencies like the Environmental Protection Agency (EPA) will require giving agencies more discretion to implement procedures that are more cost-effective. The EPA is already implementing efforts to reduce reporting requirements and integrate risk assessment into regulatory action. Proper risk assessment requires distinguishing and understanding relative risk and comparative risk.

The Small Business Regulatory Enforcement Fairness Act

Article Abstract:

The Small Business Regulatory Enforcement Fairness Act may further complicate the regulation of small businesses more than it will harmonize small business needs with agency action. The Act contains provisions on attorney fees and judicial review provisions that are central to the Act's intent to restrain agency actions regarding small businesses. These provisions may generate litigation.
