Positive discipline and labor arbitration

Article Abstract:

There is a trend among management in the disciplining of employees toward positive discipline, which encourages employees to change their behavior by reasoning with them, and away from progressive discipline, which imposes increasing levels of punishment. Decisionmaking leave with pay is being used in place of suspension without pay. Arbitrators have expressed mixed opinions about positive discipline and need to become more familiar with it.

AIDS in the workplace: judicial and arbitral responses

Article Abstract:

Arbitrators should educate themselves about certain issues that are unique to AIDS-related employment disputes as the number of people with AIDS and the amount of related litigation grows. Irrational fear should never be a more powerful influence than sound medical knowledge. The factor that usually decides AIDS-related employment disputes is the person's ability to do the job.

Immunity vs. liability in arbitral adjudication

Article Abstract:

Arbitral immunity is the keystone of the arbitration system and should not be overturned. As more disputants choose to arbitrate, questions of arbitral liability will increase. However, immunity is necessary for finality of arbitrators' decisions. Few cases against arbitrators have been filed in nations allowing arbitral liability.
