Predatory pricing in the airline industry: proposed guidelines of the U.S. Department of Transportation

Article Abstract:

Manyy discount air carriers have sprung up since the Airline Deregulation Act of 1978 in an attempt to make the 'hub-and-spoke' system of the six major airlines more competitive. Most have failed, and each of the major airlines now operates a 'fortress hub' in a large US city. Only about 15% of the US airline industry operates at competitive prices and the other 85% charges monopoly fares. The text of a Department of Transportation enforcement policy on exclusionary conduct in the airline industry is given.

The Dept of Transportation's inability to overcome the courts' definition of predatory pricing has limited its ability to go after airlines. The department's 1998 guideline changes are discussed as to whether they will resolve this problem.

Predation 'strategy' of American Airlines: a change of heart at the Justice Department?

Article Abstract:

The Dept of Justice's change in policy toward predatory pricing, from a policy which denied its existence to one attacking it, and the impact of this change on American Airlines in the courts, is examined.
