Project: the decriminalization of administrative law penalties; civil remedies, alternatives, policy and constitutional implications

Article Abstract:

Administrative agencies have started pursuing civil remedies, rather than criminal sanctions, to promote compliance with regulatory and administrative laws. Reasons for the pursuit of civil remedies vary, but usually arise from a desire to speed up the administration of justice and give civil laws more flexible enforcement procedures. The constitutionality of such moves, however, is open to question. The distinctions between civil and criminal law and the use of each by administrative agencies is discussed in detail.

The continuing need for an administrative conference

Article Abstract:

The regulation of the administrative process necessitates an advisory oversight board similar to the disbanded US Administrative Conference. This governmental body should contain leaders who have worked directly with agencies and also possess a small, permanent staff to provide not only efficient administration but institutional memory. Many countries have similar boards in recognition of the benefits of having a dedicated organization seeking to resolve problems and provide guidance.

The authors trace the history and development of independent federal agencies, with the Interstate Commerce Commission serving as an example. Topics include the basic model of the modern independent agency, internal procedures, and the tension between autonomy and accountability.
