Public performance rights in sound recordings and the threat of digitalization

Article Abstract:

Digital audio transmission systems are dramatically reshaping the sound recording industry, necessitating legislation in the area of performance rights, where copyright law historically has protected owners but not the performers themselves. The laws governing compensation for sales and broadcasting of sound recordings will become outdated if digital audio cable services continue to expand to include audio-on-demand services, known as the "celestial jukebox." Legislation pending in 1995 addresses some of the issues, but fails to grant comprehensive rights for all parties including broadcasters, composers, publishers and performers.

Rights & relief under the Disabilities Act

Article Abstract:

The Americans with Disabilities Act (ADA) specifies administrative or judicial relief for proven acts of discrimination, and for every title of the act a federal government unit has jurisdiction. Exhaustion of the grievance procedures of respective public entities is not necessary before filing a complaint with federal agency or court, and the complainant can also go to court first. The ADA provides for various means of alternative dispute resolution and these do not prevent the complainant from filing a complaint against the entity involved in the original dispute.

FDA ban on steroid is sound

Article Abstract:

The Food and Drug Administration's (FDA) import ban on RU 486 is based on sound medical evidence. At least one death and several life-threatening cardiovascular accidents have been attributed to the drug's use. Side effects include severe pain, nausea and bleeding. Contrary to the assertions of the pro-abortion forces, the FDA has not tried to impede research involving RU 486. Pro-abortion forces have over-emphasized preliminary results regarding non-abortifacient uses of the drug.
