RICO and conspiracy construction: the mischief of the economic model

Article Abstract:

The Supreme Court upheld the RICO Act in 1997 in Salinas v. US. RICO allows defendants to be convicted of conspiracy based on participation in a criminal enterprise. However, the Court's approval overlooked the damage RICO did by replacing the traditional common-law principle of no guilt without proof of a culpable act concurrent with a culpable deed with an economic model of criminal law.

Client perjury: an ever present, multidimensional problem

Article Abstract:

The author argues that perjury and should no longer be a crime. He sees the criminalization of perjury as an affront to dignity. He also claims that it violates the United States Constitution, particularly the ban on self-incrimination.
