Reform of the control machinery under the European Convention on Human Rights: Protocol No. 11

Article Abstract:

Protocol No. 11 of the European Convention on Human Rights calls for creation of a new court to reform the convention's control machinery. However, the appeals system outlined in the protocol is unsatisfactory. It makes all judgments of the new court provisional and dependent on the parties' decision to appeal. Under the existing system, control over cases is divided between the European Commission and the European Court of Human Rights, and the procedure can take as much as ten years. The protocol must be ratified or formally accepted by all thirty nations who are parties to the European Convention.

The Kyoto Protocol to the United Nations Framework Convention on Climate Change

Article Abstract:

The Kyoto Protocol to the Convention on Climate Change represents the first legally binding international agreement for identifying and reducing man-made emissions causing global climatic changes. The complex Protocol identifies base emission levels, setting standards for emission reduction strategies and compliance procedures. The flexible Protocol conditions allow for emissions trading and country-specific implementation and compliance provisions.

The UN Preparatory Committee on the Establishment of an International Criminal Court advanced in its mission to formulate a comprehensive legal system addressing criminal conduct related to warfare. Committee groups drafted positions on definitions of war crimes, procedure, foundations of criminal law, state collaboration, criminal procedure and punishments.
