Securities class action litigation developments under the Private Securities Litigation Reform Act of 1995 - the adequacy of notice and appointment of lead plaintiff and the stay of discovery during the pendency of a motion to dismiss under the PSLRA

Article Abstract:

The Private Securities Litigation Reform Act of 1995 changed the requirements for notice and appointment of lead plaintiff and the scope of discovery stay for dismissal motions in securities class action suits. Failure to meet requirements can lead to dismissal or being denied lead plaintiff status. The notice and discovery stay requirements are discussed.

Selection of lead plaintiff under the Private Securities Litigation Reform Act of 1995

Article Abstract:

The Private Securities Litigation Reform Act of 1995 changes procedures in securities class action suits for the selection of lead plaintiffs. The act changes the presumption of what constitutes a lead plaintiff and plaintiff certification. It also changes notice requirements.

Article Abstract:

Major issues raised under the Private Securities Litigation Reform Act of 1995 include the notice and appointment of lead plaintiff and the discovery scope on motions to dismiss stays. A survey of cases involving these two issues is presented.
