Settling the score; good negotiation skills pave the way for better settlements

Article Abstract:

The best rule of thumb for a settlement conference is preparation. Clients should be prepared and told that the purpose of the conference is compromise. Preparation should include a knowledge of the local rules on such conferences, having a rationale for the settlement offer ready, and having a strong settlement statement to bring to the conference. Lawyers should take control by speaking first, thus forcing the other side to react, avoid inflammatory issues and mention the money as soon as possible.

The buck stops where? It's bad business to hide potential malpractice claims from insurers

Article Abstract:

Attorneys should remember that failure to notify an insurer of a malpractice claim can result in loss of the policy. The three situations in which this can be the case involve reasonable action, prompt notice and material misrepresentation. Most states do not require deliberate intent to hide a claim to rescind a policy. Ways to minimize the risk of not having malpractice coverage are listed.

LSC setbacks offer new opportunities; volunteers and private contributions can help the poor attain equal justice

Article Abstract:

Governmental cutbacks in funding of the Legal Services Corp (LSC) afford the legal profession an opportunity to demonstrate its professionalism by enhanced voluntary activity in serving the poor and in making financial contributions for such service. Many state bar associations and some related state organizations have already made efforts in this direction.
