State variations on the Daubert theme: Texas

Article Abstract:

The authors address the Texas Supreme Court's analysis of the US Supreme Court's Daubert v. Merrell Dow Pharmaceuticals, Inc. decision, regarding the admissibility of expert testimony. The Texas Supreme Court's ability to review appellate court decisions on the admission or exclusion of expert testimony is discussed.

Article Abstract:

The authors discuss the admissibility of expert testimony in California courts. The effect of US Supreme Court's Daubert decision on the California Supreme Court's long-standing Kelly/Frye analysis for proving general acceptance of a challenged technique by the scientific community is discussed.

The admissibility of expert testimony under the Florida Evidence Code is discussed. Topics include a comparison of the 1923 Frye test to Daubert v. Merrell Dow Pharmaceuticals, Inc. and application of the Frye test by the Florida Supreme Court.
