Who will ensure that a patient's living will is enforced?

Article Abstract:

Trust and estate lawyers, acting on behalf of patients as estate planners, must enforce their patients' wishes. Nurses and primary-care physicians have proven either unwilling or unable to act on health care directives as defined by living wills or advance directives. Some health maintenance organizations promote the use of health care powers of attorney. Living wills permit every US citizen with access to health care to avoid an unnecessarily protracted process of dying.

When can an estate deduct expenses of maintaining and selling the decedent's residence?

Article Abstract:

Costs for maintaining and selling a decedent's residences are usually not deductible, except when three factors pertain. The decedent's representative must establish that the costs are necessary and reasonable, that the estate does not have enough assets to pay debts and expenses, and if the decedent's will or trust has directed the property be sold as part of estate administration.
