New tool for job bias suits; two circuits say the ADA covers hostile work environments

Article Abstract:

Rulings by the US Courts of Appeals for the 4th and 5th Circuits confirming a trend in federal district courts to recognize disability-based claims of hostile work environments are discussed. The rulings use a similar approach to Supreme Court ones recognizing hostile work environment claims under Title VII.

Suits test environment jurisdiction; can U.S. courts treat rain forest damage like genocide?

Article Abstract:

Suits to hold US corporations liable for environmental destruction to foreign lands face obstances such as international comity and forum non conveniens. Whether international law's recognition of genocide and torture as violations could be extended to environmental injuries is also a question. Environmental tort claims under the Alien Tort Claims Act are sure to increase and environmentalists are also encouraging countries to adopt environmental standards.

ADA: clarified or ruined? Disabled community is dismayed; business gives a sigh or relief

Article Abstract:

The US Supreme Court in 1999 issued three rulings on the ADA dismaying to the disability rights community, while employers expressed relief. The court ruled that those whose disabilities can be corrected by medical devices or medicine cannot use the ADA to claim protection from discrimination. The court also used agency principles to limit employer liability for punitive damages.
