Putting the squeeze on juries

Article Abstract:

Evidence of an anti-jury movement, including appellate courts' increasing tendency to dismiss the power of juries, is discussed. Leaders of the movement argue that civil juries are much too generous with damages, too soft on crime, and unable to understand the issues in complex litigation. Tort reform laws and binding arbitration have also decreased the power of juries.

Article Abstract:

The increases in the power of the jury and in their ability to demand societal changes are discussed. Many recent examples are given, and critics charge that jurors are unqualified to decide complex cases on which even experts disagree.

Switch-hitters saving the day; two corporations looking to settle lawsuits hire plaintiffs lawyers

Article Abstract:

The unconventional step of Sulzer Orthopedics and Bridgestone-Firestone of hiring plaintiffs lawyers Wayne Reaud and Richard Scruggs to craft settlements helping the companies avoid court and bankruptcies is discussed. The Sulzer settlement allowed the company to admit total liability while making a limited payout.
