Tax assessment of contaminated property: tax breaks for polluters?

Article Abstract:

Assessment of property tax on polluted land should allow for the loss of market value due to hazardous material contamination. The Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA) and similar state laws enforce cleanup of polluted sites and assign attendant cleanup costs to the owner or polluter. Public taxes should not contribute to such costs, and one way to avoid this is to adopt a valuation method in use by the Oregon Department of Revenue.

Aerial pest eradication in Massachusetts and California and the pesticide malathion

Article Abstract:

Massachusetts and California should adopt more stringent laws protecting the public and environment from pesticides. Both states have used malathion pesticide in such a way that the public and environment were widely exposed. State courts will not find wide spraying unconstitutional, and in California an unjustified state of emergency was declared to allow spraying. The state legislators must take action to remedy the problem.
