That control thing; employment status of worker defines tax obligations

Article Abstract:

The IRS is increasing auditing to make sure that the classifications of 'employee' and 'independent contractor' are appropriately used. Employers not sure of employment status can request a ruling from the IRS with Form SS-8. Employers who wish to avoid the paperwork and withholding of taxes necessary for an employee should have an independent contractor agreement, have the worker bill them for services, and file an IRS Form SS-9 if pay will amount to more than $600 annually. Adverse rulings by the IRS can be costly.

Crunch time; last-minute tax planning can still pay off in 1992

Article Abstract:

There are a number of year-end steps possible to help cut down on 1993 income taxes. Deferring income and accelerating deductions are one possibility. The recognition of a capital gain can be deferred by selling a security short and having it delivered the following year. Stock-owners should also keep in mind the possibilities for offsetting previously recognized gains in selling securities at a loss. Qualified pension plans are still the best tax shelter.

It's hard to sell out; as more Americans show interest in starting businesses, lawyers must be ready to guide them through the sale or dissolution that may be waiting down the line

Article Abstract:

Record levels of small business bankruptcies occur even in a thriving economy, and an increasing number of corporate counsel clients are focused on the acquisition of businesses engaged in workouts, especially those performed outside normal bankruptcy proceedings. Both the entrepreneurs and the lawyers who advise them must know the complexities of the relevant law. Various experts give their view of some of these complexities.
