The Asgrow paradigm

Article Abstract:

The decision of Asgrow Seed Co v. Winterboer will result in increased plant patents and legislation to grant exemptions for farmers for use of protected plants and animals. Asgrow allowed farmers to sell the seed from protected bioengineered species as long as the seed came from less than half of the crop total. This undercut the protections of the Plant Variety Protection Act, and will lead to patents as an alternative protection. As farmers seek further latitude in legislation, vigilance will be necessary.

Brown bagging it - free lunch for farmers

Article Abstract:

The decision of Asgrow Seed Co v. Winterboer has opened new seed varieties to marketing by farmers, and breeders should now protect their new seeds both with patents and under the 1970 Plant Variety Protection Act. The decision allows seeds saved from a crop to be sold by farmers if the total falls short of half of the harvest. The multiplication factor of many seeds coming from the plant which grows from one seed will effectively put farmers in competition with the breeders of protected new varieties.

From litigation to ADR: Brown & Root's experience

Article Abstract:

Brown & Root implemented a successful employee dispute resolution program (DPR) in June 1993. Three hundred employees contributed opinions about the program's formation. Eighty percent of the disputes were successfully resolved during the first two years. The DPR provides employees with four options: the opportunity to meet with management, a conference with a DPR representative, formal mediation or formal arbitration.
