The Fair Labor Standards Act and child labor in agriculture

Article Abstract:

Myths regarding the wholesomeness of child agricultural labor and abuses of the parental exemption dictate that child labor laws should not distinguish between agricultural labor and other forms of labor. The Fair Labor Standards Act and supporting regulations should be amended to better protect the interests of children working in agriculture. The influence of rural legislators and the economic needs of agriculture do not justify compromising children's safety when dozens of children are injured and killed each year working on farms.

Arbitration - the court opens the door to arbitration of employment disputes

Article Abstract:

The Supreme Court has broadened the power of arbitration in its decision in Gilbert v. interstate/Johnson Lane Corp. The court decided that employees who sign agreements to arbitrate are bound by those agreements even it means they have to give up certain federal rights that they may have received if the dispute went to court. The court effectively vindicated arbitration as a viable means of dispute resolution, including disputes involving statutory rights.
