The Spanish application of the UNCITRAL Model Law on International Commercial Arbitration

Article Abstract:

The UNCITRAL Model Law on International Commercial Arbitration is prepared with the intention of establishment of a united legal framework for the fair and efficient settlement of disputes in international commercial relations. This Model Law proved to be an attractive standard for reform of national arbitration laws while the application of this Model Law to both international and domestic arbitrations increases the international accessibility of Spanish law as well as the attractiveness of Spain as an arbitral seat.

The New Austrian Arbitration Act and the European Convention on International Commercial Arbitration

Article Abstract:

The article compares the elements of the new Austrian Arbitration Act based on the UNCITRAL Model Law and the European Convention on International Commercial Arbitration. They are found to be mostly consistent and complementary, although the Austrian Act seems more favorable for an international convention for harmonizing national laws than the regional approach of the European Convention.

Evidence in international arbitration

Article Abstract:

A combination of civil law and common law concepts form the rules and principles that apply to all arbitrations unless the parties decide otherwise. However, in International arbitration there is an absence of restrictive rules governing the form, submission, admissibility and evaluation of evidence.
