The Super League litigation: has Klor's Inc. v. Broadway Hale Stores come down under?

Article Abstract:

The Australian Federal Court's decision in News Ltd. v. Australian Rugby Football Ltd. reveals a conflict between the policy purposes behind Australia's Trade Practices Act 1974 section 45(2) and the EU's treaty article 85. The decision more closely reflects policy as seen in the US case Klor's Inc. v. Broadway Hale Stores. Section 45(2)'s aim is to promote 'workable competition' where the EU law aims for common market integration.

Time and risk: the temporal dimension of competition analysis and the role of long-term contracts

Article Abstract:

An analysis of time's effects should be incorporated into competition law to account for the element of risk. Long-term contracts have proven to be competitive and can be explained through examining time's effects in the presence of durable capital. Time in competition should be analyzed using different periods with different industries and dynamic instead of static.

Anti-competitive conduct in telecommunications

Article Abstract:

The Australian telecommunications industry opened to full competition as of Jul 1997, as part 11B of the Trade Practices Act 1974 came into effect. The law defines anti-competitive conduct, and outlines remedies and penalties. The Australian Competition and Consumer Commission has also issued guidelines.
