The TTAB and the Paris Convention: pleading Article 10 and 10bis claims before the Board

Article Abstract:

False origin charges may be brought by foreigners before the the Trademark Trial and Appeal Board, but the board is reluctant to grant such claims unless they fit under the Lanham Act and the Paris Convention for the Protection of Industrial Property. Claims under articles 10bis and 10 of the Paris Convention are insufficient for the board to grant a direct cause of action. Filing claims under section two of the Lanham Act allows grounds for cancellation of registration, as shown by case law.

Harnessing politics: the dynamics of offset requirements in the tax legislative process

Article Abstract:

Congressional rules which control legislating the federal budget perform beneficial functions of information acquisition and of ordering educated debate regarding choices. Tax law is ultimately the result of decisions regarding appropriations and expenditures informed by competing interest groups. Legislative offset rule provisions function to improve legislative decisionmaking and even result in reduced federal spending.

The Iraqi claims process and the ghost of Versailles

Article Abstract:

The process of war claims against Iraq for the 1990-1991 Gulf War should be modified to allow greater participation by Iraq. The current process resembles the 1919 Treaty of Versailles in which Germany had no active role in reparations and the seeds of World War Two were sown. Iraq should be brought into the United Nations claims tribunal, which will make it more likely that the claims will be paid.
