The U.S.-U.K. arbitration concerning Heathrow Airport user charges

Article Abstract:

Settlement was reached on Mar. 11, 1994, on the longstanding dispute between the U.S. and the U.K. concerning user charges at Heathrow Airport. The settlement was reached after an unprecedented arbitration procedure that began in Dec. 1988, after diplomatic efforts had reached an impasse. Much of the dispute arose from imprecise language in Article 10 of the U.S.-U.K. Air Services Agreement of 1977. The parties agreed to binding arbitration and adapted procedural rules of the International Centre for Settlement of Investment Disputes, rules used in international commercial arbitration.

Awarding interest in international arbitration

Article Abstract:

The inconsistencies in awarding interest in international commercial arbitration could be resolved by adopting a model which resolves interest claims in accordance with any existing arbitration clause. Absent such a clause, interest could be awarded from the default date, compounding quarterly as it accrues at a reasonable rate. Despite a general consensus favoring interest awards based on the default date, laws have been misapplied in determining circumstances warranting interest and decisions on rates have varied from country to country.

Commercial arbitration - representation by foreign counsel - illegal practice of law in California

The California Supreme Court ruling in Birbrower, Montalbano, Condon & Frank v. Superior Court, regarding a foreign attorney's unauthorized practice of law in a commercial arbitration, is discussed.
